1. GENERAL PROVISIONS

These Terms and Conditions (hereinafter "Terms and Conditions") outline the rules and regulations for the use of Pažaiskim, MB's website (hereinafter "website"), located at https://newpast.lt.

By accessing this website, we assume you (hereinafter "Buyer") accept these Terms and Conditions. Do not continue to use website if you do not agree to take all of the Terms and Conditions stated on this page.

The website is owned and operated by Pažaiskim, MB, business registration code 305812670, Saldenės k., Vilniaus r., Lithuania (hereinafter “Pažaiskim, MB”, “Seller”, “we” or “us”). Pažaiskim, MB contact information is provided in the "Contact Us" section.

Downloading content from the website is only allowed for personal, non-commercial use, provided you keep the copyright intact. 2. TERMS AND CONDITIONS FOR SALE

The below Terms and Conditions shall apply to all deliveries from Pažaiskim, MB, Saldenės k., Vilniaus r., Lithuania, business registration code in Lithuania 305812670, to customers purchasing goods in online shop.

2.1. CONCLUSION OF CONTRACT

A final and binding contract has been concluded between the Buyer and the Seller when the Buyer pays for the order. Once the Buyer has placed and paid for the order, an email confirming the receipt of the order will be sent to the Buyer.

2.2. PRICES

All prices are stated inclusive of VAT. The applicable price is the one stated in Pažaiskim, MB online shop in respect of the relevant product on the date of placing of the order.

Payments are processed using the STRIPE platform.

• Apple Pay and/or Google Wallet.

2.4. DELIVERY

Goods ordered through this website will only be delivered to Lithuania.

Orders are processed within approximately 1-2 business days after the payment is received. Delivery options available: Omniva, DPD, LP EXPRESS parcel lockers.

2.4.1 DELIVERY TIMES

Orders will arrive at the parcel machine you have chosen within approximately 1-4 business days after payment. If payment was made during the weekend or a holiday, the delivery will be made within approximately 1-4 business days from the end of the weekend or holiday period.

Once an order is shipped, we will send you tracking information so you can see where your item is at any time. However, delays do happen sometimes - please contact us if it takes really long.

We are not responsible for parcels that are damaged or lost during shipping due to the fault of any shipping company. No compensations will be issued unless shipping company admits the fault and issues a compensation.

2.4.2 SHIPPING OF PRE-ORDERED ITEMS

There is an opportunity to pre-order items. In this case, the typical order processing time is about 3-4 weeks from when an order is placed by a customer.

2.4.3 SHIPPING FEES

You can calculate shipping fees during the checkout.

When ordering goods in Pažaiskim, MB online shop an amount will be added in payment of shipping costs. The amount you will be charged for delivery depends on the order price:

• Parcel Lockers: Omniva, LP Express, DPD: € 2,30 or € 3,30 (depends on order price);

• Free on orders over € 100,00.

2.5. RETURNS AND REFUNDS

You are entitled to cancel your order within 14 calendar days without giving any reason for doing so.

The deadline for canceling an order is 14 calendar days from the date you received the goods or on which a third party you have appointed, who is not the carrier, takes possession of the product delivered.

In order to exercise your right of cancellation, you must inform us of your decision by means of a clear statement.

You can inform us of your decision by e-mail info@newpast.lt.

We will reimburse you (including the delivery costs paid by the Buyer) no later than 14 calendar days from the day on which we receive the returned goods. We will use the same means of payment as you used for the order, and you will not incur any fees for such reimbursement.

2.5.1 CONDITIONS FOR RETURNS

In order for the goods to be eligible for a return, please make sure that:

• The goods were purchased in the last 14 calendar days;

• The goods are in the original packaging;

• The goods are unused and unworn.

2.5.2 RETURNING GOODS

You are responsible for the cost and risk of returning the goods to us.

You can return your order using Omniva, DPD, LP EXPRESS parcel lockers. Your return package must be returned to the following address: Saulės g. 1, Avižieniai, Vilniaus raj. (Vilniaus Avižienių MAXIMA).

We cannot be held responsible for goods damaged or lost in return shipment. We are unable to issue a refund without actual receipt of the goods or proof of received return delivery. No refunds will be issued for returned items that have been lost by delivery carrier unless delivery carrier admits the fault and issues a compensation.

2.6. RETURN AND EXCHANGE OF DEFECTIVE GOODS

Defective goods purchased on the website are returned and/or exchanged in accordance with Articles 6.363 and 6.364 of the Civil Code of the Republic of Lithuania, as well as the Government of the Republic of Lithuania of 2014. July 22 "Retail Trade Rules" approved by Resolution No. 738.

2.7. LIABILITY

Pažaiskim, MB is not liable for any delays or for non-performance due to force majeure. For as long as a force majeure situation persists, Pažaiskim, MB is relieved from performance of its obligations.

3. License

Unless otherwise stated, Pažaiskim, MB own the intellectual property rights for all material on New Past. All intellectual property rights are reserved. You may access this from New Past for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Copy or republish material from New Past;

• Sell, rent, or sub-license material from New Past;

• Reproduce, duplicate or copy material from New Past;

• Redistribute content from New Past.

4. Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time.
